An ignition interlock device may seem like a terrible inconvenience, but it is better than license revocation. State legislatures across the country have struggled with how to reduce the injuries and death caused by drunk drivers.
New York recently enacted "Leandra's Law" which, among other things, requires that if you are convicted of drunk driving, you must have an interlock installed on your car. It also requires you to pay for installation, maintenance and repair.
The device is a sort of Breathalyzer that tests your alcohol level and will prevent your car from starting if you blow higher than .02. The law is named for a child who was killed in a drunk driving accident. Mothers Against Drunk Driving and other groups have lobbied to enact tough laws and prevent lenient penalties.
If you drive with a blood alcohol concentration of .08 or greater or under the influence of alcohol or drugs while a child is in the car, you face felony charges. The Child Passenger Protection Act (CPCA) provides for jail time up to four years. If a child is injured or killed while you drive under the influence, you could face a sentence of 25 years.
Naming the law for a lost child shows the strong feelings and motivation of lawmakers and lobbying groups. New York is tough on drinking drivers, and you need a vigorous advocate to minimize consequences you face.
